Grandparents have the burden to prove to the court that it is in the best interests of the child(ren) that they be allowed to visit with their grandchild(ren). Moreover, before courts will even consider enforcing a grandparent's rights to visitation, the grandparent must establish that he or she has a "standing" to seek visitation. This includes proving to the court that there is already a healthy bond between the grandparent(s) and the grandchild(ren). There are no hard and fast laws governing when circumstances exist that a grandparent's rights to visitation are to be allowed.; Every case is different and must be determined by the circumstances surrounding it.
